Development and neoextractivism: socio-environmental conflicts and the necessary prior consultation in infrastructure projects

Resumo: This paper proposes to investigate the effectiveness of the right to free, prior and informed consultation in the implementation of infrastructure projects that affect traditional peoples and communities. For this, the analytical method is used, as well as bibliographic and descriptive research and qualitative approach method. The extractive development model adopted in Brazil has invested in the installation of infrastructure megaprojects, such as the construction of Hydroelectric Power Plants and Dams. With the construction of these megaprojects, risks and impacts arise that are borne by the affected traditional peoples and communities. Brazil is a signatory to Convention No. 169 of the International Labour Organization (ILO), which establishes the right to free, prior and informed consultation of peoples who may eventually be affected by projects or works on their territory, as well as the right to consent. The right to prior consultation is an instrument for protecting the rights of traditional peoples and communities in the face of infrastructure projects and is carried out through the Autonomous Consultation Protocols, which establish how the State should consult them.

Para tal, utiliza-se o método analítico, bem como a pesquisa bibliográfica e descritiva e método de abordagem qualitativo. O modelo de desenvolvimento extrativista adotado no Brasil tem investido na instalação de megaprojetos de infraestrutura, como a construção de Usinas Hidrelétricas e Barragens. Com a construção desses megaprojetos, surgem riscos e impactos que são suportados pelos povos e comunidades tradicionais afetados. O Brasil é signatário da Convenção nº 169 da Organização Internacional do Trabalho (OIT), que estabelece o direito à consulta livre, prévia e informada dos povos que eventualmente possam ser atingidos por projetos ou obras em seu território, bem como o direito ao consentimento.
