Indigenous land in the state of Rondônia: Priority in payment for environmental services as a vector of sustainable development

Resumo: This paper aims to analyze the context and legal foundations for the application of the Payment for Environmental Services Program in Indigenous Lands as an instrument to induce environmental preservation and implement the Principle of Human Dignity. The new Law n.° 14.119/2021, which establishes the National Policy on Payments for Environmental Services, brought greater regulation to base the application of the Payment for Environmental Services. In addition, in its article 5, III, and article 6, § 2, prioritizes the use of this instrument to promote the socio-environmental, economic, and cultural development of rural and urban populations and rural producers, with priority given to traditional communities, indigenous peoples, and family farmers. Environmental preservation in indigenous lands is debated through Payment for Environmental Services, highlighting its requirements. Next, the issue of promoting the environmental economy is discussed. It is concluded that the gratification (PSA) to the indigenous population for environmental protection is adequate, with priority given to those communities whose lands maintain the preserved environment.

La nueva Ley n.º 14.119/2021 que establece la Política Nacional de Pago por Servicios Ambientales trajo mayor regulación para fundamentar la aplicación del Pago por Servicios Ambientales, además, en su art. 5, III y en el art. 6, § 2, estableció el uso de este instrumento para promover el desarrollo socioambiental, económico y cultural de las poblaciones en áreas rurales y urbanas y de los productores rurales, con prioridad para las comunidades tradicionales, pueblos indígenas y agricultores familiares. Se debate la preservación ambiental en Tierras Indígenas a través del Pago por Servicios Ambientales, destacando sus requisitos. A continuación, se aborda el tema de la promoción de la economía ambiental. Se concluye que la gratificación (PSA) a la población indígena por la protección ambiental es adecuada, dando prioridad a estas comunidades, cuyas tierras mantienen el medio ambiente preservado.O presente artigo visa analisar o contexto e os fundamentos jurídicos para aplicação do Programa de Pagamento de Serviço Ambientais nas Terras Indígenas como instrumento indutor de preservação do meio ambiente e concretizador do Princípio da Dignidade Humana. A nova Lei n.º 14.119/2021 que institui a Política Nacional de Pagamento por Serviços Ambientais trouxe maior regulamentação para basear a aplicação do Pagamento de Serviço Ambientais, além disso, em seu art. 5º, III e n.º art. 6º, § 2º, estabeleceu a utilização desse instrumento para promoção do desenvolvimento socioambiental, econômico e cultural das populações em área rural, urbana e dos produtores rurais, com prioridade para as comunidades tradicionais, povos indígenas e agricultores familiares. Debate-se a preservação ambiental nas terras indígenas por meio do Pagamento Por Serviços Ambientais, evidenciando seus requisitos. Em seguida se discute a questão da promoção da economia ambiental.
