Resumo: This research establishes a relationship between the theoretical of philosophical hermeneutics of the phenomenological tradition and subjectivity in legal interpretation, proposing a critical reflection on the discretionary power, the subjectivity of the interpreter and the freedom of belief, observing the absence of phenomenological ideals about the role of the judge.
