Resumo: The general objective of this research is to compile information and discuss the incident of disregard for legal personality. The study is justified by its importance in the phatic and legal scope, since the institute of the disregard of the legal personality is an essential figure to promote balance and stability in commercial relations, since this institute has the power to guarantee that the obligations contracted by the legal entity will be respected, freeing the commercial environment from instability and fear of committing fraud. To this end, the present research will be carried out by means of a bibliographic review, promoting the bibliographic research with consultation in books, scientific articles, legislation and other documents that are relevant to the development of the theme. Thus, the legal personality of companies will be conceptualized, observing the technical aspects of the theory of disregard for legal personality and how it is applied in Brazilian law considering the new Code of Civil Procedure. In addition, the possibility of reverse disregard of the legal personality, the appropriate procedural moment for the use of the institute and the procedure to be applied will be analyzed, seeking a complete and in-depth review of the main aspects of the proposed theme

O estudo se justifica por sua importância no âmbito fático e jurídico, pois o instituto da desconsideração da personalidade jurídica é uma figura essencial para promover equilíbrio e estabilidade nas relações comerciais, uma vez que este instituto tem o poder de garantir que as obrigações contraídas pela pessoa jurídica serão respeitadas, livrando o meio comercial da instabilidade e do medo do cometimento de fraudes. Para tanto, a presente pesquisa será realizada por meio de revisão bibliográfica, promovendo a investigação bibliográfica com a consulta em livros, artigos científicos, legislações e demais documentos que sejam relevantes ao desenvolvimento da temática. Assim, se conceituará a personalidade jurídica das empresas, observando os aspectos técnicos da teoria da desconsideração da personalidade jurídica e como esta é aplicada no direito brasileiro à luz do novo Código de Processo Civil.
