This work aims to analyze the legal nature of the leniency agreement in the light of Law No. 12.846/2013 (Anti-Corruption Law). Due to the lack of consensus in Brazilian doctrine and jurisprudence, this theme gives rise to more than one interpretation, which can lead to consequences that are inappropriate with administrative principles. The problem this study aims to address is to determine whether the Public Administration would be obliged to enter into a leniency agreement if it complied with the legal requirements, or whether it would eventually be free to choose not to do so, based on the exercise of its discretionary powers. A critical analysis of the subject is presented, based on the interpretation of this legal institute, through the application of the principles set out in the Federal Constitution and encompassing the themes of the corruption panorama in Brazil, Consensual Administration and the impossibility of administrative agents exercising their free will in fulfilling their duties. Finally, the possibility of a leniency agreement favoring corruption, rather than fighting it, in the event that it is the result of discretion on the part of the public authorities, will be analyzed
