Resumo: This article aims to study and analyze the situation of people with disabilities in the labor market e the legal protection given by the Democratic State of Law. It is known that, despite Constitution protection and non-statutory laws, people with disabilities face many obstacles to get included in the formal labor market. In order to solve this kind of exclusion, public policies have been implemented to integrate these people in society, mostly by the application of the principles of equality and human dignity. To achieve the effective application of these principles and legal protection, the State established specific Acts to protect people in this situations, and developed the affirmatives actions, which aims to integrate people with disabilities in the society and mainly, in the formal labor market. The study is extremely important because it is necessary to change the current scenery to put these people into an equal, solidarity and fair society. This article adopted to show through literature reviewTrata-se de um trabalho destinado ao estudo da situação das pessoas com deficiência no mercado de trabalho e a proteção legal ofertada pelo Estado Democrático de Direito. É sabido que, apesar da proteção Constitucional e infralegal, as pessoas com deficiência têm grandes dificuldades na sua inclusão no mercado de trabalho. Para combater essa exclusão, políticas públicas são adotadas, visando a integração dessas pessoas na sociedade, mediante aplicação dos princípios constitucionais da igualdade e dignidade da pessoa humana. Para que seja evidenciada e alcançada a aplicação efetiva desses princípios e tutelas, o Estado instituiu a chamada "reserva de mercado" mediante a Lei de Cotas, bem como inseriu as chamadas "ações afirmativas", que visam integrar a pessoa com deficiência na sociedade e principalmente no mercado de trabalho. O tema é de extrema importância pois é necessário que o cenário atual seja modificado e cada vez mais, essas pessoas sejam devidamente incluídas em uma sociedade mais igualitária, solidária e justa.
