The object of this paper belongs to the subject matter of international law branch of private law, whose dissertation examined practical issues regarding foreign investment and globalization, with main emphasis on its regulation under the law and internationally. The study examined the Article 172 of the Federal Constitution and the Law 4131 of 03 September 1962 and 4390 of 29 August 1964, however, overlooked the doctrinal aspects and had as main objective, the production of certain critical points laws, always aiming to focus on the practical reality and effectiveness of national legislation with the recent changes in legislation on the subject. During the development of the monograph have been addressed several theoretical issues and practices that, until now, are causing questions and providing doctrinal divergent understandings on foreign investment and globalization. With the submission of questions, the analysis of several authors and specialists in the subject through our position on critical legal and doctrinal texts, we come to the end of the work based on our understanding of the importance of foreign investment to the Brazilian economy and world, and as on the need for creation of global rules on the subject, including the resumption of discussions on a treaty on international investment in the OECD and to the UN
