Resumo: This work discusses the disapproval precedent, focusing on its contribution to the development of the Law through the inclusion of judges from lower courts in the debate about the necessity of overruling a precedent from a higher court. Beginning from the account of the development of the stare decisis in the English law and the incorporation of the binding precedents to the Brazilian law, this work analyzes the legal culture of the common law towards the precedent, portraying the concepts and outlines of the legal precedent, ratio decidendi and obiter dictum, the operation of distinguishing and overruling of precedents and their related techniques, among which stand out the disapproval precedent, what is done through the comparison between the theory and practice of common law with the legal provisions that regulate the subject in the Civil Procedure Code and the judicial reality in Brazil
