Resumo: With the coming of Law 13.146/2015, to rule in January 2, 2016 , there was a reconstruction of the theory of incapacity in Brazilian Civil Law. The main change was to consider people with mental disabilities fully able to exercise the acts of civil life, including the exercise of existential rights. This change is due to the humanistic approach of civil law, which from the Federal Constitution of 1988 now is the basis of the Federative Republic of Brazil to human dignity. Thought good intention of the Legislative power, the legal system for the protection of persons with disabilities in the acts that practice and the juristic act were negatively affected, in particular the void system. This work, after an evolutionary theme of the study aims to find alternatives to keep the protection of these people in the negotiating framework , preserving the new humanist legal regime of disabilities.

A principal mudança foi considerar as pessoas com deficiência mental plenamente capazes para o exercício dos atos da vida civil, inclusive para o exercício de direitos existenciais. Tal mudança se deve ao enfoque humanista do direito civil, que a partir da Constituição Federal de 1988 passou a ter como fundamento da República Federativa do Brasil a dignidade da pessoa humana. Em que pese a boa intenção do legislador, o sistema jurídico de proteção das pessoas com deficiência com relação aos atos jurídicos que praticam e aos negócios jurídicos que celebram foi negativamente afetado, em especial o sistema das invalidades.
