Resumo: This paper seeks to analyze the constitutive characteristics of work analogous to slavery, brought about by article 149 of the Brazilian Penal Code, in order to understand the current Brazilian scenario, focusing on the dignity of the human person as a legal asset to be protected and the prevention of submission to degrading working conditions. In addition to analyzing and debating the combat and prevention work of entities and public bodies to eradicate work in subhuman and degrading conditions. The choice of the topic in question is justified by its social and humanitarian relevance, as well as the sad reality of the subject in question today, seeking to make a historical and jurisdictional analysis, bearing in mind the current performance of the Labor Prosecutor's Office and the Ministry of Labor and Employment and the possibility of applying stricter and more effective standards. The deductive method will be used for documentary and bibliographical research based on Brazilian legislation and conventions 29 and 105 of the International Labor Organization (ILO – in Portuguese, OIT)

The deductive method will be used for documentary and bibliographical research based on Brazilian legislation and conventions 29 and 105 of the International Labor Organization (ILO – in Portuguese, OIT)O presente trabalho busca analisar as características constitutivas do trabalho análogo à escravidão1, trazidas pelo artigo 149 do Decreto-Lei no 2.848, de 7 de dezembro de 1940 (doravante denominado Código Penal Brasileiro) (Brasil, 1940)2, com intuito de entender o cenário atual Brasileiro, tendo foco na dignidade da pessoa humana como bem jurídico a ser tutelado e a prevenção a submissão a condições degradantes de trabalho. Além de analisar e debater sobre o trabalho de combate e prevenção de entidade e órgãos públicos para erradicar trabalhos em condições subumanas e degradantes. A escolha do tema em apreço tem como justificativa a sua relevância social e humanitária, além da triste realidade da atualidade do tema em questão, buscando fazer uma análise histórica e jurisdicional, tendo em mente a atuação atual do Ministério Público do Trabalho e Ministério do Trabalho e Emprego e a possibilidade de aplicação de normas mais rigorosas e com maior efetividade.
