Summary: The article, after a brief reflection concerning the health status of aging individuals, elucidates on how the supplementary health system assists the aging population in Brazil, emphasizing the regulations implemented by the responsible agency related to the sector. These legal norms aim for the proper stabilization of a healthcare network based on prevention instead of only ailments treatments, alongside with an ample focus on the caregiver.  For such, risk stratification and functional capacity are highlighted as an indispensable foundation.

Estas normas legales buscan la implantación de una red de atención a la salud pautada en la promoción de esta última y no sólo curadora, sino con enfoque más cuidador. Para ello, destaca la estratificación de riesgos y la capacidad funcional como balizadores de ésta. O artigo, após uma breve reflexão sobre a saúde do idoso, explana sobre como o sistema de saúde suplementar no Brasil vem assistindo este segmento etário, dando ênfase às normatizações realizadas pela agência reguladora do setor. Estas normas legais buscam a implantação de uma rede de atenção à saúde pautada na promoção desta última e não apenas curadora, mas com enfoque mais cuidador.
