É a partir da década de 90 que o tema da regulação independente começa a ganhar destaque no Brasil, influenciado pelas experiências americanas e europeias, o país se encontrava envolto por uma série de mudanças estruturais, como a redemocratização, a falência do modelo de Estado Intervencionista e os processos de privatização e reforma do aparelho estatal. Este estudo busca evidenciar os elementos caracterizadores do regime especial desses entes reguladores e se o Poder Executivo respeita essas prerrogativas, visto que, desde 2001 as agências reguladoras são alvo de constantes Projetos de Lei, Decretos e Pareceres visando minorar suas competências e autonomias. Esta análise, por fim, permite perceber como o Governo Federal brasileiro age perante um órgão administrativo dotado de regime especial, que não está sob sua subordinação e concluir que, de fato, há sim uma tentativa de interferência nas atividades das autarquias especiais. Nossa justificativa para escolha e delimitação do tema, surgiu durante os estudos de regulação pública e concorrência no ordenamento português, que, com o aprofundamento do assunto foram surgindo dúvidas a respeito do modelo brasileiro e como o Poder Central se portava diante dessa recente forma de regulação. Questionamentos como: O que constitui a independência regulatória para o ordenamento brasileiro? Por qual motivo optou-se por esse modelo? No Brasil, as agências são realmente independentes do Governo? Como o Poder Executivo se relaciona diante da independência desses órgãos? Assim, partindo dessas indagações chegamos ao recorte e delimitação do foco desse estudo, qual seja, analisar como e de que forma o Poder Executivo se posiciona frente as prerrogativas de independência das agências reguladoras brasileiras.The objective of this thesis is to deepen the analysis about the main characteristics of the Brazilian Independent Regulatory Agencies, in order to verify if they are effectively independent at the national context. In the 1990s, the theme of independent regulation has begun to gain prominence in Brazil, influenced by the American and European experiences, the country was surrounded by a series of structural changes, such as redemocratization, the failure of the Interventionist State and the processes of privatization and reform of the State. The study seeks to highlight the legal elements that characterize the special regime of these regulatory bodies and whether the Executive Branch respects these prerogatives, because since 2001, regulatory agencies have been the target of constant bills, decrees and legal opinions aiming to reduce their powers and autonomy. Finally, this analysis reveals how the Brazilian Government acts before an administrative body with a special regime, which is not under its subordination, and concludes that, in fact, there is indeed an attempt to interfere in the activities of the special agencies.Our justification for the choice and delimitation of the theme arose during the studies of public regulation and competition in the Portuguese system, which, with the deepening of the subject, were doubts about the Brazilian model and how the Central Power behaved before this recent form of regulation . Questions like: What constitutes the regulatory independence for the Brazilian order? Why did you choose this model? In Brazil, are agencies really independent of the Government? How does the Executive Power relate to the independence of these organs?
