Resumo: Disserta sobre o artigo 461, § 5º, do Código de Processo Civil, a partir do resgate histórico do processo civil clássico e seus objetivos, bem como o surgimento do princípio da efetividade da tutela jurisdicional. A adoção da ação sincrética e das tutelas mandamental e executiva lato sensu está explicitada no bojo do artigo 461, na tutela específica das obrigações de fazer e de não fazer. Estabelece um paralelo entre o artigo citado e o instituto do contempt of court.

The adoption of syncretic action and lato sensu mandatory and executive guardianships are explained in Article 461, in the specific protection about the obligations of doing and not-doing.
