Sua justiça também foi prevista pela própria Constituição, o que lhe dá ampla aceitação e importância. Ocorre que o esporte extrapolou os limites da prática esportiva por simples diversão, sendo, nos tempos modernos, meio principal de subsistência de muitos atletas, o que faz com que ocorram conflitos de interesses por conta dos enormes valores que movimenta. O esporte de rendimento passou a requerer um alto nível de desempenho e excelência dos atletas e de toda a estrutura que o faz funcionar. Assim, surgem, derivados do esporte, variadas demandas postas à apreciação da justiça, o que conferiu ao Direito Desportivo enorme importância e exigiu uma maior dedicação por parte dos estudiosos deste novíssimo ramo do direito pátrio. Este trabalho busca abordar toda a base e doutrina referente ao Direito Desportivo, dando especial atenção ao conflito de competência que surge entre a justiça especializada desportiva, chancelada pela própria Constituição, e a Justiça Comum e a Justiça Trabalhista, tendo em vista a incidência de normas estrangeiras sobre a matéria no ordenamento pátrio e as várias conseqüências que as decisões desportivas causam em outros campos do direito, e vice-versa.The Sport is a social phenomenon, and as such, is present in the Brazilian Constitution, precisely in the title on the social order. His justice was also provided by the Constitution, which gives wide acceptance and importance. It turns out that the sport beyond the limits of sports activities for fun, and in modern times, the primary means of livelihood of many athletes, which makes conflicts of interest occur because of the enormous wealth that moves. The sport of income has to require a high level of performance and excellence of the athletes and the whole machine that makes it work. Therefore, they derived the sport, varied demands placed on the assessment of justice, which gave the Sports Law enormous importance and called for greater commitment on the part of scholars of this brand new branch of law homeland.
