Ou seja, cuida-se aqui de uma nova vertente da responsabilidade civil, é a possibilidade de reparação pela perda de uma chance, ou, em outras palavras, o ressarcimento pela perda da oportunidade de almejar determinada vantagem ou é claro evitar um prejuízo. O tema será abordado sob a ótica da responsabilidade civil e representa uma significativa evolução no direito civil constitucional. Conforme se verifica na literatura especializada, a Teoria da Perda de uma Chance nasce, em 1865, na França, onde juristas locais vêem a possibilidade jurídica da indenização à vítima, por perda de uma chance. A teoria em análise tem como precursor o pesquisador italiano Adriano de Cupis (1960), considerado o maior pensador no que tange ao real alcance da perda da possibilidade e sua possível indenização. Trata-se de um tema muito interessante e novo na doutrina e na jurisprudência, porém vem angariando ampla repercussão nas decisões dos tribunais brasileiros.The axis of this article-is the paradigmatic theory of liability for loss of a chance.
