Nesse sentido, o primeiro capítulo inicia-se com o significado do princípio da supremacia da Constituição e percorre os aspectos históricos do controle de constitucionalidade e a sua evolução no Brasil e no mundo. Posteriormente, essa abordagem utilizará os aspectos materiais e formais, assim como os mecanismos doutrinários e jurisprudenciais do Controle Constitucional. No segundo capítulo será realizado o estudo doutrinário e jurisprudencial acerca do ativismo judicial e as suas formas, iniciando pelos pilares do Direito, da moral e da legitimidade que se tornam essenciais para a compreensão da jurisdição constitucional e os seus principais desafios. Ademais, a visão contemplada pelo positivismo jurídico será de inigualável importância para sistemática do objeto de estudo. Ainda no segundo capítulo a Proposta de Emenda Constitucional n. 33/2011 será analisada, tendo em vista o seu caráter de restrição às diversas funções consagradas pela Constituição ao Poder Jurisdicional. Nesse diapasão, com o intuito de comprovar a tese acerca do ativismo judicial exercido pelo Supremo Tribunal Federal será tratada a Arguição de Descumprimento de Preceito Fundamental n. 54/2004.This paper intends to show the importance of Judicial Activism assigned to the Judiciary Power. Accordingly, the first chapter begins approaching the meaning of the principle of constitutional supremacy, besides going through historical aspects of Constitutionality Control and its evolution in Brazil and other countries, prizing the main events of that concept – from its birth to the evolution of Constitutionality Control nowadays. Following, this paper will approach material and formal aspects, as well as doctrinal and jurisprudential approaches of Constitutionality Control. Consequently, Judicial Activism will be analyzed in several aspects, being conceived Law pillars such as the moral and legitimacy, both essential to understand constitutional jurisdiction and its main challenges. Moreover, the point of view contemplated by legal positivism will be of primary matter in order to systematize the object of study. Thus, the Proposal of Constitutional Amendment number 33/2011 will be poised, in view of its feature of restriction to several functions which are hallowed by the Constitution to Jurisdictional Power.
