Enormes foram as modificações sofridas para adaptá-lo a realidade que se viveu e hoje se vive. O processo cautelar, que em sua criação tinha como objetivo servir ao processo principal, passou a ser utilizado com o fito satisfativo, haja vista que a mora judicial causava, em algumas situações, mais prejuízo que a violação ao direito. A criação da antecipação dos efeitos da tutela foi pedra fundamental para solucionar a celeuma. A morosidade não foi solucionada, mas a fruição dos efeitos da execução da futura sentença puderem ser sentidos antes que ela se tornasse imutável. O processo executivo, que antes gozava de certa autonomia, passou a ser mera fase do processo de conhecimento, aproveitando-se a citação já realizada. Diminui-se a complexidade, eliminando retardamentos desnecessários. Tendo em mente que as modificações não foram suficientes para que o judiciário rápido e preciso em suas decisões é que o anteprojeto do Novo Código de Processo Civil traz a tutela de evidência, com o escopo de preencher o vazio deixado pelo atual sistema processual.The Buzaid’s Civil Procedure Code force 38 years in Brazil.
