Resumo: The welfare state is the result of political, legal and economic development and it is its duty to ensure a social safety net. In Brazil, social security had as its historical mark the low coverage and the maintenance of historical privileges. With the advent of the 1988 Constitution, the social security system of public employees is definitely approaching the social security model of the general regime. From 2012 onwards, the supplementary social security of civil servants with limitation of social security benefits to the maximum of the general regime was effectively instituted. These amendments include an approximation to the constitutional principle of equality and solidarity, although military, by maintaining privileges not found in other inactivity regimes, remains a violation of the postulate of equality.
