Creation of municipalities and territorial autonomy

Resumo: This article thinks through territorial autonomy as a mechanism underlying the creation of municipalities. Since colonial times, when the first municipality appeared on Brazilian soil, in 1532, the process of creating and installing them has always been a continuing process. The Brazilian municipality has always enjoyed a certain autonomy. In the colonial period, for instance, this autonomy was factual, extralegal, but it proved to be key for territorial defense and occupation. Even in rather centralized regimes, such as the Empire, or conservative ones, such as the 1964 dictatorship, Brazil never stopped creating municipalities. After the 1988 Federal Constitution, the number of municipal emancipations grew a lot and municipal autonomy also increased. Many local communities saw the opportunity to dismember their territory and become autonomous. From a procedural viewpoint, this study has been based on a literature review on the concepts territory and autonomy and their historical presence in the building process of the Brazilian municipal network. As a result, it was found that, throughout the country’s history, the essence of creating municipalities is territorial autonomy, which has been molded to specific historical circumstances. The territorial autonomy acquired by dividing a territory into municipalities provides local residents with political participation and, hence, citizenship, in addition to access to public resources.

Desde la época colonial, cuando apareció el primer municipio en suelo brasileño, en 1532, el proceso de creación e instalación de los mismos ha sido siempre continuo. El municipio brasileño siempre disfrutó de cierta autonomía. En el período colonial, por ejemplo, esta autonomía era fáctica, extralegal, pero resultó ser clave para la defensa y la ocupación territorial. Incluso en regímenes más centralizadores, como el Imperio, o conservadores, como la dictadura de 1964, Brasil nunca dejó de crear municipios. Después de la Constitución Federal de 1988, creció mucho el número de emancipaciones municipales y también aumentó la autonomía municipal. Muchas comunidades locales vieron la oportunidad de desmembrar su territorio y convertirse en autónomas. Desde el punto de vista procedimental, este estudio se basó en una revisión bibliográfica sobre los conceptos territorio y autonomía y su presencia histórica en el proceso de construcción de la red municipal brasileña. Como resultado se encontró que, a lo largo de la historia del país, la esencia de la creación de municipios es la autonomía territorial, la cual ha sido amoldada a circunstancias históricas específicas. La autonomía territorial que se adquiere al dividir un territorio en municipios proporciona participación política a los residentes locales y, por tanto, ciudadanía, además de acceso a recursos públicos.Cet article propose une réflexion sur l’autonomie territoriale comme mécanisme sous-tendant la création des municipalités. Depuis l’époque coloniale, lorsque la première municipalité est apparue sur le sol brésilien, en 1532, le processus de création et d’installation a toujours été continu. La municipalité brésilienne a toujours eu une certaine autonomie. A l’époque coloniale, par exemple, cette autonomie était factuelle, extralégale, mais elle s’est avérée fondamentale pour la défense et l’occupation du territoire. Même dans des régimes plus centralisés, comme l’Empire, ou conservateurs, comme la dictature de 1964, le Brésil n'a jamais cessé de créer des municipalités. Avec la Constitution Fédérale de 1988, le nombre d’émancipations municipales a beaucoup augmenté et l’autonomie municipale s’est également accrue. De nombreuses communautés locales ont vu l’opportunité de démembrer leur territoire et de devenir autonomes. D’un point de vue procédural, cette étude s’est appuyée sur une revue bibliographique des concepts territoire et autonomie et leur présence historique dans le processus de construction du réseau municipal brésilien. En conséquence, il a été constaté que, tout au long de l’histoire du pays, l’essence de la création des municipalités est l’autonomie territoriale, qui a été modelée sur des conjonctures historiques spécifiques. L’autonomie territoriale acquise par la division du territoire en municipalités assure la participation politique des résidents locaux et, par conséquent, la citoyenneté, en plus de l'accès aux ressources publiques.Este artigo traz uma reflexão sobre a autonomia territorial como mecanismo subjacente à criação de municípios. Desde a época colonial, quando surgiu o primeiro município em terras brasileiras, em 1532, o processo de criação e instalação deles sempre se deu de maneira constante. O município brasileiro sempre teve certa autonomia. No período colonial, por exemplo, essa autonomia era fática, extralegal, mas se mostrou fundamental para a defesa e a ocupação territorial. Mesmo em regimes mais centralizadores, como o Império, ou naqueles conservadores, como a ditadura de 1964, o Brasil nunca deixou de criar municípios. Com a Constituição Federal de 1988 cresceu, muito, o número de emancipações municipais e também aumentou a autonomia municipal. Muitas comunidades locais vislumbraram a oportunidade de desmembrar seu território e se tornarem autônomas. Do ponto de vista procedimental, este estudo se baseou em revisão bibliográfica sobre os conceitos território e autonomia e sua presença histórica no processo de construção da malha municipal brasileira. Como resultado, constatou-se que, ao longo da história do país, a essência da criação de municípios é a autonomia territorial, que foi se moldando às conjunturas históricas específicas.
