Resumo: In the face of a process of increasing overcoming ofphysical and bureaucratic borders in the international economicscenario, the nation-state has become too small to regulate privatetransnational business relationships, as its sovereignty is limitedby political territorial lines that no longer represent real economic flows. Therefore, this paper questions how the democratic nation-state can regain its decision-making sovereignty in a “borderless” world? This paper intends to disseminate the discussion on theneed to expand democratic boundaries in the global economicfield. For this, the deductive method and bibliographic review will be used. This paper considers that the elaboration of asupranational legal order is one of the possible ways to overcomethe current crisis of the Nation-State.
