Resumo: A patient gives informed consent, which is composed of information and previous deliberation, to medical professionals for a specific treatment. In addition, informed consent is also a bioethical instrument used for strengthening doctor-patient relationships. Furthermore, this paper investigates the usefulness of informed consents. Nonetheless, it is a helpful tool for avoiding lawsuits and aids in determining the applicable rule of law. Moreover, this study used law books and the TJRS and STJ case studies.

É visto hoje como instrumento da bioética para o fortalecimento da relação médico paciente. O objetivo desse trabalho é investigar em que medida o consentimento informado pode ser útil a fim de evitar demandas judiciais contra médicos, bem como determinar o estatuto jurídico aplicável, que fundamenta a sua necessidade.
