THE UNCONSTITUTIONALITY OF CONDEMNATION TO THE TEN OF PROCEDURAL COSTS TO POPULAR AUTHORS AND DIRECTORS OF ASSOCIATIONS IN PUBLIC CIVIL ACTIONS

Resumo: Popular action and public civil action are embodied in the main procedural instruments for the satisfaction of meta-individual legal rights, understood as those that go beyond the legal sphere of only the plaintiff, who so does it in a skillful way to satisfy diffuseor coletive desires society. In addition to instruments of popular participation and institutions organized in the exercise of state power and management of public competences, they are characterized by the nobility of spirit through which a certain subject, notably when disassociated from the state structure, takes responsibility for proposing action seeking interest that is not only yours, but, on the contrary, is an indeterminacy of individuals, with no possibilityof obtaining a singular benefit. The gratuity of these actions is therule and their exceptional cases must merit strict interpretation,so as not to subvert the constitutional order. The present work seeks to evaluate the unconstitutionality of the infraconstitucional normative that provide for the cost of ten times the legal costs to popular authors or directors of associations that promote public civil actions, through doctrinal analysis and jurisprudence, under the deductive method.

Além de instrumentos de participação popular e de instituições organizadas no exercício do poder estatal e gestão das competências públicas, caracterizam-se pela nobreza de espírito através da qual um determinado sujeito, notadamente quando desassociado da estrutura estatal, assume a responsabilidade de propositura de ação judicial buscando interesse que não é só seu, mas, ao contrário, é de uma indeterminação de indivíduos, sem possibilidade de obter singular benefício. A gratuidade destas ações é a regra e as suas hipóteses de exceção devem merecer interpretação restrita, de molde a não subverter a ordem constitucional.
