An essay analyzing the right to be forgotten: its limits, origin, and pertinence with the brazilian judicial system

Resumo: This study focuses on the problematic topic of the ‘right to be forgotten’, while analyzing it alongside current perspectives of existing advances in information and communication technology. Moreover, this paper explores this right´s origin, its object of protection, and its pertinence as an autonomous right in the Brazilian legal system. Therefore, using the inductive approach, this body of research examines various court cases, which are considered the leading cases of this field, subsequently analyzing law books´ definitions of the right to be forgotten. In conclusion, this study verifies that the indexation problematic was a great innovator on this subject and in the context of the right to be forgotten, which, despite not being a new right, sustains new meaning in modern day law.

Desta feita, com base no método indutivo de abordagem, o artigo analisa diversos julgados considerados como leading cases no enfrentamento da temática e, então, passa a análise da construção doutrinária do direito ao esquecimento.
