Resumo: | DOI: 10.12957/dep.2016.22951Resumo O artigo apresenta os resultados de uma pesquisa realizada junto ao Tribunal de Justiça do Rio Grande do Sul acerca da receptividade da nova ordem jurídico-urbanística brasileira em demandas julgadas entre 2011 e 2015. Os achados indicam que uma peculiar forma de ativismo judicial é praticada pelo tribunal, já que a efetividade do Estatuto da Cidade mostrou-se maior quando o Poder Público se encontra no polo passivo das ações e menor quando particulares têm o direito de propriedade questionado em juízo. Tal maneira seletiva de aplicar a lei implica em um fortalecimento do “modelo proprietário” em detrimento do paradigma emergente. A investigação revela que o desconhecimento da nova ordem jurídico-urbanística por parte tanto dos litigantes quanto dos magistrados também explica a baixa efetividade do Estatuto da Cidade nas trincheiras do Poder Judiciário. Abstract This article presents the results of a survey on the receptiveness of the Brazilian new legal-urban order involving the decisions of the Rio Grande do Sul Court of Appeals between 2011 and 2015. The findings indicate that a particular form of judicial activism is practiced by the court since the effectiveness of the City Statute was higher when public authorities are defendants in the lawsuits and lower when individuals have the right of ownership questioned in court. Such selective way to apply the law implies a strengthening of the “proprietary model” to the detriment of the emerging paradigm. The survey suggests that lack of knowledge about the new legal-urban order on the part of both litigants and magistrates explains the low effectiveness of the City Statute in the judicial trenches.
