Medidas socioeducativas e cultura punitiva: o recrudescimento do controle das expressões da questão social no Brasil

Summary: The present theses objective is to analyze the socio-educational measures for adolescents in Brazil and its relation to the persistent punitive culture that prevails in our society. The control of the expressions of the social question through a punitive culture and the criminalization of poor adolescents is one of the most cruel facets of socio-educative measures. The instrumentality of this culture is amplified as a selective mechanism of the pauperized segments in society mainly black people and inhabitants of poor areas. Intensification of the Barbary related to the destructive forces activated to turn effective the civilization excluding projects gains even more functionality in the actual stage of capitalism. The administration of the surplus and those useless in regard to the market depend on the amplification of the punitive system, evincing that the penal aspect of the State is one of the expressions of neo-liberalist. These processes linked to the globalization of capital have major impacts in Brazil, as result of the social, politic and economic background that became stronger within the historic process of development of capitalism. The consensus for the increase of punitive actions has become more evident in this context. The Socio-educational Measures have become instruments of control and neutralization of the so-called dangerous classes or of those considered superfluous by the capital. The legal achievements in the range of infancy and adolescents rights like the Statute of the Child and Adolescent (ECA/1990) and the National System of Socio-educative Support (SINASE/2012), although relevant mechanisms of protection, they were not sufficient to dissolve the punitive and authoritarian logic that rules Brazilian society. As research was elaborated, more clear became the historic and consensual punitive hegemony in our society. In order to build on the comprehension of the reality of the subject here presented, this research interviewed Social Workers who are involved with the Socio-educational measures in Rio de Janeiro through the focus group method. The study aimed to recognize the contradictions experienced by the social assistants in these spaces: the tension caused by the urge to defend human rights frustrated by the punitive practices related to social control of these teenagers. Finally, it may be possible to conclude that the punitive culture has a centrality in the Socio-educational arena that means much more than just to neutralize a crime or a criminal . It proves to have become a powerful ideological tool of elimination of social individuals.

O controle das expressões da questão social por meio da cultura punitiva e da criminalização dos adolescentes pobres tem nas MSEs uma de suas mais cruéis facetas. A instrumentalidade dessa cultura se amplia como mecanismo seletivo dos segmentos pauperizados da sociedade - predominantemente negros e moradores de periferias. O recrudescimento da barbárie, relacionada às forças destrutivas ativadas para efetivação de projetos excludentes de civilização, ganha maior funcionalidade no atual estágio do capitalismo. A administração dos sobrantes e inúteis ao mercado depende do alargamento do sistema punitivo, evidenciando a face penal do Estado como uma das expressões do Estado neoliberal. Estes processos, que estão vinculados à perspectiva da mundialização do capital, no Brasil possuem maiores impactos, procedentes da formação social, política e econômica que se edificou ao longo do processo histórico de desenvolvimento do capitalismo, ficando evidente o consenso pela ampliação da punição. As MSEs acabam por ser instrumentos de controle e neutralização das denominadas "classes perigosas" e/ou daqueles supérfluos ao capital. As conquistas legais no âmbito da infância e adolescência, como o Estatuto da Criança e do Adolescente (ECA/1990) e do Sistema Nacional de Atendimento Socioeducativo (SINASE/2012), ainda que relevantes, não foram suficientes para dissolver a lógica punitiva e autoritária reinante da sociedade brasileira. À medida que os estudos foram se aprofundando, mais ficava evidente a consensual e histórica hegemonia do punitivismo em nossa sociedade. Para aprofundar a compreensão da realidade a partir da visão em relação ao objeto estudado, os profissionais do Serviço Social envolvidos com as MSEs no Rio de Janeiro foram inseridos na pesquisa por meio da metodologia do grupo focal. Buscou-se ainda reconhecer as contradições vivenciadas pelos assistentes sociais nestes espaços: a tensão entre defender direitos e conviver com práticas punitivas vinculadas ao controle social destes jovens. Por fim, conclui-se que a cultura punitiva possui uma centralidade nas MSEs para muito além da neutralização de um crime ou criminoso .
