Resumo: O impulso para o desenvolvimento deste trabalho despontou da divergência doutrinária e jurisprudencial acerca da adoção da coisa julgada secundum eventum probationis nas ações individuais previdenciárias. Destaca-se que o tema assume peculiar importância, tendo em vista a atual sistemática imprimida ao processo previdenciário, no sentido de buscar a celeridade e, ao mesmo tempo, garantir ao segurado ou ao dependente a satisfação de seu direito ao benefício. Neste sentir, considerando que a questão envolve princípios jurídicos que ocupam lugar de relevância no ordenamento jurídico, como o devido processo legal e a segurança jurídica, buscou-se solucionar a controvérsia através da compatibilização do instituto da coisa julgada com os valores previstos constitucionalmente, a fim de se obter um processo mais probo e efetivo à luz do formalismo-valorativo.

It should be emphasized that the issue is of particular importance given the current system of social security, in order to seek for celerity and, at the same time, ensure the satisfaction of the beneficiary or the dependent.
