A defensoria pública como instrumento de defesa dos direitos da mulher em situação de violência doméstica, familiar e intra-familiar

Resumo: | Desde a Antiguidade, a relação entre os sexos foi marcada pelo domínio e coerção do homem, por um lado, e pela submissão e resistência da mulher, por outro. Várias instituições, como a Igreja, exerceram forte influência na divulgação de uma cultura misógina. O patriarcado foi consolidado na sociedade auxiliado pelo Direito, no qual a mulher é colocada numa situação de obediência à ordem estabelecida pelos homens. O papel da mulher na sociedade sempre foi estabelecido pelos homens e seu destino escolhido por eles. A violência de gênero contra a mulher surge nas situações em que se rompem os papéis e funções preestabelecidas como padrões de normalidade para ambos os sexos. A defesa dos direitos da mulher e a erradicação de todas as formas de discriminação e violência constituem compromissos dos estados democráticos de direito. Dentre os tratados ratificados pelo Brasil merecem destaque a ?Convenção da Organização das Nações Unidas sobre a Eliminação de todas as Formas de Discriminação contra a Mulher? ? CEDAW e a ?Convenção Interamericana para Prevenir, Punir e Erradicar a Violência contra a Mulher?, que tratam especificamente dos direitos das mulheres. No âmbito interno, a Constituição Federal de 1988 significou importante marco para a efetivação da igualdade entre homens e mulheres. Na legislação infraconstitucional, merece destaque a Lei 11.340/06 - Lei Maria da Penha, primeira legislação brasileira a tratar especificamente sobre os mecanismos de prevenção, combate e erradicação da violência doméstica e familiar contra a mulher. Na defesa dos direitos da mulher, a Defensoria Pública desempenha importante papel e atua como mecanismo de promoção de direitos e acesso à justiça à mulher em situação de violência. A Defensoria Pública é instituição essencial à função jurisdicional do Estado, todavia, não foi criada pelo constituinte originário de 1988 apenas para prestar assistência judiciária, mas assistência jurídica integral às pessoas hipossuficientes. Sua atuação não pode ser confundida apenas com a prestação jurisdicional resultante das ações judiciais, mas deve significar a efetivação, no mundo dos fatos, das garantias dos princípios constitucionais do Estado Democrático do acesso à justiça e da igualdade, proporcionando à mulher em situação de violência doméstica e familiar toda a orientação e acompanhamento necessários ao exercício de seus direitos a uma vida digna, livre, justa, igualitária e sem violência. |
