A atuação da rede de proteção dos direitos das crianças e dos adolescentes: fios de tecituras na proteção dos direitos

This thesis aims to analyze the performance of the network that makes up the guarantee system on the rights of children and adolescent protection. We started from the problem: How has the network protection for the rights of children and adolescents been constituted, with the north the full protection policy advocated by the ECA? Has the practice of social actors guaranteed the rights of children and adolescents? Which tools do we use? It is being understood that in the face of advances in legislation resulting from the doctrine of full protection of the rights of children and adolescents, the network does not work in an integrated and coordinated way, it has not being guaranteeing the human dignity of the child and adolescent. We defend the thesis that the rights positivized in the law are not enough for there to protect children and adolescents because the practices of the institutions and social actors do not consider the peculiar condition of development, or the principle of human dignity, since they are based practices hygienists paradigms that serve as political control mechanisms of the state to the detriment of Integral Protection policy.. Theoretical support was sought from the perspective of human rights from human dignity beyond the need for assertiveness laws, the historical-cultural perspective of Vygotsky that considers the environment as a trainer, promoting elements for constitution of the subject and a network design as a mediator between the rights and policies. As methodological procedures there was made a survey of the institutions working on child rights Guarantee Scheme and adolescents in the Municipal Council for the Rights of Children and Adolescents of Araguaína - TO and after identification of the institutions used the semi-structured interviews with ten social actors responsible for institutions identified. Data analysis used the Bardin Content Analysis. From the speeches of social actors, it was noticed a dysfunctional network, characterized by lack of coordination between the institutions that comprise it. There is a unanimous complaint of lack of return and non-functioning of the Network. They have also emerged from the speeches, the lack of training of social actors, as regards including the legal aspects, which implies biased and stigmatizing practices that prevail under eighteen age and strong family blaming speech model for the violation of rights. The concept of childhood and adolescence is rooted in a naturalistic conception and development in stages, disregarding the environment in which the individual lives as an important factor for development, this way these subjects are treated in a homogeneous way, disregarding the particularities. It is perceived that the peculiar criterion subject under development is questioned and seen as an error of law, that it should be considered adults and children with the same obligations and penalties. It is observed from the speeches that the network is in opacity due to the dismantling of social policies, to the lack of understanding of the law and the various interpretations that it is given, stereotypes and stigmas that children have been treated and teenagers committing the criterion of human dignity as a universal principle of all.
