Centro de Ciências Jurídicas. Direito.O presente trabalho tem como objetivo analisar a inexistência do requisito da voluntariedade no acordo de colaboração premiada celebrado com imputado preso. Para tanto, primeiramente realizou-se um estudo sobre o conceito do instituto, traçando-se a distinção entre delação e colaboração premiada. Em seguida, tratou-se da natureza jurídica da colaboração premiada, por meio de um esboço sucinto acerca da diferenciação entre meio de prova e meio de obtenção de prova, bem como foi apresentado o regramento legal dado ao instituto no ordenamento jurídico brasileiro. Posteriormente, efetuou-se um estudo sobre os pressupostos de admissibilidade e os requisitos de validade do acordo de colaboração premiada, focando-se especialmente no requisito de validade da voluntariedade e nas suas peculiaridades. Em continuidade, buscou-se avaliar de que forma a restrição da liberdade está sendo utilizada como instrumento coercitivo para forçar o investigado ou acusado a celebrar o acordo de colaboração premiada, especialmente por meio das prisões cautelares. Por fim, procurou-se analisar se o cerceamento da liberdade afeta a vontade do indivíduo, de modo a sustentar se a voluntariedade está ou não presente no acordo de colaboração premiada de colaborador preso. Apresentou-se, ainda, o Projeto de Lei nº 4.372/2016 como uma alternativa para a solução do problema levantado no presente trabalho, uma vez que este projeto propõe condicionar a homologação judicial do acordo de colaboração premiada à circunstância do imputado estar em liberdade. Utilizou-se do método indutivo para o desenvolvimento deste trabalho, adotando-se como procedimentos instrumentais materiais bibliográficos, jurisprudências e legislações.This study aims to analyze the inexistence of the free will of the defendant in the rewarded collaboration made with an arrested defendant. For that, first of all, was realized a research about the concept of rewarded collaboration, establishing the difference between the institute of turn state’s evidence and the institute of rewarded collaboration. Then, the legal nature of the rewarded collaboration was analyzed from the perspective of placing it as a mean of evidence or mean of obtaining evidence and was introduced the laws that talk about the institute of rewarded collaboration in the brazilian legal system. After, was accomplished an investigation about the admissibility assumptions and the validy requirements of the rewarded collaboration, especially about the validy requirement of defedant’s free will. Next, was examined how the restriction of freedom is being used as instrument of coercion to force the investigated or accused to conclude the rewarded collaboration agreement, mainly through the provisional arrests. Lastly, was realized an analysis if the restriction of freedom affects the individual’s will, in order to sustain if the defendant’s free will is present or not in the rewarded collaboration agreement made with an arrested defendant. Also, the bill no. 4.372/2016 was introduced as an alternative to solve the problem presented in this study, because this bill proposes that it be established as a condition for court approval of the rewarded collaboration that the defendant is at freedom.
