STATE INTERVENTION IN THE ECONOMIC ORDER BY REGULATION AND ITS EFFECTS TO ENTREPRENEURIAL ACTIVITY

Resumo: The objective of this article is the analysis of the state intervention in the economic order through regulation and its effects for the company exercise. The deductive method was used to elaborate the present paper and the research carried out has been done with bibliographic-documentary basis. The work was structured in three chapters, within the presentation of the concept of state and normative order by Hans Kelsen. Therefore, the business activity was analyzed and the limits imposed by the constitutional principles of free initiative and free competition for the State to act in the face of entrepreneurs. It was verified that, in relation to the company, there are informational and governance difficulties of the regulatory agencies in their segments. Finally, it is concluded that it is necessary to implement new processes of public governance with a view to reformulation of standards and efficiency gains for entrepreneurs, according to the regulated sectors.

El método deductivo fue utilizado para la elaboración del trabajo y la investigación realizada fue de carácter bibliográfico-documental. El trabajo está estructurado en tres capítulos, a partir de la presentación del concepto de Estado y orden normativo por Hans Kelsen. Por consiguiente, se trató sobre la actividad empresarial y los límites impuestos por los principios constitucionales de la libre iniciativa y de la libre competencia para la actuación del Estado frente a los empresarios. Se verificó que, en relación a la empresa, hay dificultades informacionales y de gobernanza de las agencias reguladoras en sus segmentos. Al final, se concluye que es necesaria la implementación de nuevos procesos de gobernanza pública con miras a la reformulación de las normas y la ganancia de eficiencia para los empresarios, conforme a los sectores regulados.O objetivo do presente artigo é a análise da intervenção estatal na ordem econômica por meio da regulação e seus efeitos para o exercício da empresa. O método dedutivo foi utilizado para elaboração do trabalho e a pesquisa realizada foi de caráter bibliográfico-documental. O trabalho está estruturado em três capítulos, a partir da apresentação do conceito de Estado e ordem normativa por Hans Kelsen. Por conseguinte, tratou-se sobre a atividade empresária e os limites impostos pelos princípios constitucionais da livre iniciativa e da livre concorrência para atuação do Estado em face dos empresários. Verificou-se que, em relação à empresa, há dificuldades informacionais e de governança das agências reguladoras em seus segmentos. Ao final, conclui-se que é necessária a implementação de novos processos de governança pública com vistas à reformulação das normas e ganho de eficiência para os empresários, conforme os setores regulados.
