STATE INTERVENTION IN THE ECONOMIC ORDER BY REGULATION AND ITS EFFECTS TO ENTREPRENEURIAL ACTIVITY

Resumo: The objective of this article is the analysis of the state intervention in the economic order through regulation and its effects for the company exercise. The deductive method was used to elaborate the present paper and the research carried out has been done with bibliographic-documentary basis. The work was structured in three chapters, within the presentation of the concept of state and normative order by Hans Kelsen. Therefore, the business activity was analyzed and the limits imposed by the constitutional principles of free initiative and free competition for the State to act in the face of entrepreneurs. It was verified that, in relation to the company, there are informational and governance difficulties of the regulatory agencies in their segments. Finally, it is concluded that it is necessary to implement new processes of public governance with a view to reformulation of standards and efficiency gains for entrepreneurs, according to the regulated sectors.
