A revisão do tratado de Itaipu e a necessidade de um novo marco regulatório para a compensação financeira pelo uso dos recursos hídricos: um desafio para o Brasil de 2023

Resumo: The present study aimed to analyse the present theoretical and legal structure of compensation and participation of the municipalities in financial resources from generation of electricity due to the hydroelectric potential of the watershed contribution of Itaipu Hydroelectric Power Plant. With a Geographic Information System, there was a need to review this mechanism, since the boundary of the watershed of the contribution, as opposed to the methodology currently employed, revealed a discrepancy between the real contribution of the federation units, with the water volume responsible for the hydroelectric potential, and the fact that only a few municipalities, which had flooded part of their land or contribute to the regularization of the flow, perceive these resources. The energy production and distribution in Itaipu Binacional are regulated for the Itaipu Treaty that, signed in 1973 between Brazil and Paraguay, will be reviewed in 2023. It was concluded that the water volume coming from the others federation units can not be ignored and should be subject to coverage by the law governing the compensation and participation in water source use. So, the revision of the Itaipu Treaty should consider the real participation of the Brazilian federation units upstream of the dam (barrier), in order to create Brazilian constitutional rule, and should establish a new regulatory framework for compensation for water resources use.

Em um ambiente de Sistemas de Informações Geográficas, constatou-se a necessidade de revisão deste mecanismo, uma vez que a delimitação da bacia da contribuição, contraposta à metodologia atualmente empregada, revelou uma discrepância entre a verdadeira contribuição das unidades da federação, com o volume de águas responsável pelo potencial hidrelétrico, e o fato de que apenas alguns municípios, que tiveram parte de suas terras inundadas ou contribuem para a regularização da vazão, percebem estes recursos. A produção e distribuição de energia em Itaipu Binacional são regulamentadas pelo Tratado de Itaipu que, assinado em 1973 entre Brasil e Paraguai, será revisado em 2023. Concluiu-se que o volume de águas proveniente das outras unidades da federação não pode ser desconsiderado, devendo ser objeto de abrangência pela lei que regula a compensação e participação no uso dos recursos hídricos.
