O problema de pesquisa é se e em que medida a conciliação representa um instrumento adequado para superar os obstáculos ao acesso à justiça no contexto brasileiro. A hipótese é positiva no sentido que a prática conciliatória representa, no geral, um aprimoramento no sistema judicial brasileiro. Ademais, este trabalho tem como objetivo servir de contributo ao debate mais largo acerca do acesso à justiça em função das expectativas sociais de efetivação dos direitos fundamentais. Sendo assim, o primeiro capítulo trata do movimento de acesso à justiça e sua relação com a crise do Poder Judiciário brasileiro. No segundo capítulo, a instituição jurídica da conciliação será tratada em seus aspectos culturais, legislativos e sociais, notadamente no âmbito do processo civil. No terceiro capítulo, será perquirida a previsão legal do conteúdo da conciliação no novo Código de Processo Civil. Enfim, verifica-se em termos positivos a hipótese inicial na medida que a via conciliatória apresenta-se como instrumento adequado para superar os obstáculos ao acesso efetivo à justiça. _____________________________________________________________________________ ABSTRACTThis investigation deals with the conciliation model propose in the new Brazilian Civil Procedure Code and its potentials to deal with the problematic of the lack of effective access to Justice and the excessive judicialization of conflicts in the mass society. The question of this research is if and in what measure conciliation represents an adequate instrument to overcome the obstacles to access to Justice in Brazilian context. The hypothesis is positive in the sense that the conciliatory practice represents, in general, animprovement in the judicial system. Therefore, this work has as objective to contribute to the broad debate about access to Justice in function of the social expectations in terms of concretization of fundamental rights. Then, the first chapter deals with the access to justice movement and its relationship with the Brazilian Judiciary crises. In the second chapter, the juridical institution of conciliation will be addressed in its cultural, legal, and social aspects, notably in the civil procedure sphere. In the third chapter, it will be investigate the legal prevision of the conciliation content in the new Civil Procedure Code.
