Isso pode ocorrer por meio de informações que são sugeridas para o indivíduo por pessoas e pelo ambiente, ou por meio de processos internos, sem qualquer sugestão. O estudo das falsas memórias tem grande relevância no campo jurídico, tendo em vista que a prova testemunhal é o tipo de prova mais utilizada e com o maior peso. O presente trabalho busca demonstrar as fragilidades da prova testemunhal e a necessidade de que sua valoração ocorra de forma mais cautelosa. A cautela deve estar presente também no momento da produção da prova testemunhal. O presente trabalho demonstra que os operadores do direito não possuem treinamento específico em técnicas de entrevista de testemunha, o que os leva a adotarem práticas danosas à testemunha e a preservação das memórias. Nesse sentido, é abordada a técnica da Entrevista Cognitiva, como técnica de entrevista investigativa necessária para minimizar a ocorrência das falsas memórias e construir um ambiente mais confortável e seguro para a testemunha. Finalmente, é feita uma análise do discurso acerca da prova testemunhal presente nos manuais de direito processual penal. Conclui-se que os autores, em sua maioria, ainda estão atrelados a conceitos ultrapassados acerca do funcionamento da memória e dos procedimentos inerentes à produção e valoração da prova testemunhal. It can occur through information that is suggested to the individual by people and the environment, or through internal process, without any suggestion. The study of false memories has great relevance on the legal field, considering that the testimonial proof is the type of proof most used and with greatest value. The present study intends to demonstrate the weaknesses of testimonial proof and the need that its valuation occurs cautiously. Caution must also be present now of testimonial proof production. The present study demonstrates that law professionals do not have specific training on witness interview techniques, which leads them to adopt harmful practices to the witness and to the memory preservation. In this perspective, the Cognitive Interview technique is approached as an investigative interview technique necessary to reduce the occurrence of false memories and to build a more comfortable and safe environment to the witness. Finally, it is made an analysis of the discourse about testimonial proof present on the manuals of criminal proceedings. The study finds that most part of the authors are still tied to outdated concepts about how memory works and the procedures inherent to the production and valuation of testimonial proof.
