Em ambos os casos, é possível perceber que questões ambientais passaram a relacionar-se com o comércio internacional. A relação entre esses dois regimes não é, contudo, harmônica. A crescente adoção de medidas de restrição comercial como forma de atender a objetivos de política ambiental restringe o acesso a mercados. Por outro lado, a existência de exceções à regra geral de liberalizar as trocas comerciais para assegurar objetivos considerados legítimos e, dessa forma, garantir a estabilidade doméstica gera a existência de dois tipos de protecionismo: um legítimo e outro ilegítimo. Nesse contexto, cabe ao Órgão de Solução de Controvérsias da OMC a difícil missão de identificar a existência de interesses legítimos ou de protecionismo disfarçado. A fim de verificar em que medida o OSC é capaz de identificar o limite entre o legítimo e o ilegítimo, foram selecionados nove disputas comerciais que envolveram questões ambientais. Constatou-se que não existe uma regra acaba para essa identificação e que a análise deve ser feita caso a caso. No entanto, alguns critérios foram estabelecidos pelo OSC a fim de assegurar o equilíbrio entre os direitos de os membros protegerem o meio ambiente e a obrigação de não impor obstáculos desnecessários ao comércio internacional. Essa tarefa, entretanto, não é fácil, já que tanto o desenvolvimento econômico quanto a proteção ao meio ambiente consistem em objetivos legítimos dos Estados. Nesse sentido, constata-se que a cooperação entre esses dois regimes é essencial para tratar dos conflitos que surgem da relação entre comércio e meio ambiente.The study of the relationship between trade and the environment requires, on the one hand, an analysis of the evolution of environmental regimes and, on the other, of the multilateral trade regime established after World War II. In both cases, it is possible to see that environmental issues have become intertwined with international trade. However, the relationship between these two regimes is by no means a harmonious one. The growing number of measures that restrict trade in order to meet environmental policy requirements have impeded market access. Moreover, existing loopholes in the general rule to liberalize trade so as to ensure objectives perceived as legitimate and, thereby, guarantee domestic stability have generated two types of protectionism: a legitimate one and an illegitimate one. In this context, the WTO’s Dispute Settlement Body is charged with the difficult task of sorting legitimate interests from disguised protectionism. In order to check the extent to which the DSB is able to identify the line dividing legitimate from illegitimate, nine trade disputes involving environmental issues were chosen. It was verified that there is no definitive rule to make such a judgment and that analysis must be made on a case-by-case basis. Yet, some criteria have been established by the DSB to ensure the balance between the rights members have to protect the environment and their obligation not to place undue barriers on international trade. This is no easy task, though, since both economic development and environmental protection constitute legitimate objectives of the member states.
