Resumo: The Brazilian prison system is in a precarious environment, however, when subject is transgender people, we face a more vulnerable population. Based on old behaviors, which can be intensified in the Brazilian prison system, transgendered deal with various forms of discrimination in the face of a society built on standards considered “usual". Studies show that little has been discussed about the impacts and consequences about this matter. The situation is worsened due to restrictions of gender diversity between male and female inside prisons, which do not comprise transgendered, in addition to the absence of specific legislation to regulate their conditions in prison. The research methods used are descriptive and theoretical research, analyses of books, legal scholars, scientific papers, monographs, document review, court precedents, analysis of the Sentence Execution Act (SEA) and investigations of available and relevant works to the subject discussed. This work aims to consider the creation of specific “wings” in the prison system targeted at the transgender population, raising issues that are sometimes kept in silence.

Os transexuais lidam com diversas formas de discriminação perante uma sociedade construída sobre padrões considerados “normais”. Os estudos comprovam reflexos e consequências que até então, pouco se tem questionado a respeito. A situação é agravada pelas restrições à diversidade de gênero entre feminino e masculino dentro dos presídios que não abrangem os transexuais, além da falta de legislação específica para regulamentar suas condições nas prisões. Os métodos utilizados no presente trabalho são pesquisa descritiva e teórica, estudo de livros, doutrinas, artigos, monografias, análise documental, jurisprudência, análise da Lei de Execução Penal (LEP) e investigações de obras disponíveis e pertinentes à temática discutida.
