Resumo: The rationalism synthesized the Law into cold and static formulas, making difficult its dynamics and social accompanying. The logic of reasonable, resulted from a substantial vision of the clause of “due process of law”, has as objective the justice in the creation and application of the law, having in the equity the essential tool of operation. The creative activity of the judge, which belongs to the logos of reasonable, claimed by the requirement of the fair, do not discount the maintenance of the juridical security, having as starting-point, the interpretation of the juridical rules, in a reasoning lacking the mathematical rigor, typically human.

La lógica de lo razonable, fruto de una visión sustancial de la cláusula due proceso f law, tiene como finalidad, la justicia en la creación y aplicación del derecho, tiendo en la equidad la precipua herramienta de operación. La actividad creativa del jurista, propia del logos razonable, reclamada por la exigencia del justo, no descarta la manutención de la seguridad jurídica, tiendo como premisa de partida, la interpretación de la norma jurídica, en un razonamiento desproveído de rigor matemático, típicamente humano.O racionalismo condensou o direito em fórmulas frias e estáticas, inviabilizando sua dinamização e acompanhamento social. A lógica do razoável, fruto de uma visão substancial da cláusula due processo f law, tem como finalidade, a justiça na criação e aplicação do direito, tendo na equidade a precípua ferramenta de operação.
