Resumo: Current analysis deals with basic rights as from the constitutionalization of private law. The history of the phenomenon is investigated and the evolution of fundamental rights as rights of first, second and third dimensions is analyzed. The efficiency or not of fundamental rights in private juridical relationships is discussed as from the three main theories that guide the contents, or rather, the inefficacy of fundamental rights in private relationships; the mediate efficacy of fundamental rights; and the immediate efficacy of these precepts to private relationships. The essay will concentrate on third dimension rights, especially the right to solidarity.

En este sentido, se verificará el histórico del fenómeno y, enseguida, se hará el análisis de la evolución de los derechos fundamentales, considerados como derechos de primera, segunda y tercera dimensión. Se constatará, aún, la eficacia o no de esos derechos fundamentales en las relaciones jurídicas privadas, a partir de las tres principales teorías que regulan tal contenido, o sea, la ineficacia de los derechos fundamentales en las relaciones privadas, la eficacia mediata de los derechos fundamentales; y la eficacia inmediata de esos preceptos a las relaciones privadas. Por fin, el ensayo trabajará más específicamente con los derechos de tercera dimensión, específicamente, el derecho a la solidaridad.O trabalho tratará dos direitos fundamentais a partir da constitucionalização do direito privado. Nesse sentido, verificar-se-á o histórico acerca desse fenômeno; após isso se analisará a evolução dos direitos fundamentais, enquanto direitos de primeira, segunda e terceira dimensão. Constatar-se-á, ainda, acerca da eficácia ou não desses direitos fundamentais nas relações jurídicas privadas, a partir das três principais teorias que norteiam tal conteúdo, ou seja, a ineficácia dos direitos fundamentais nas relações privadas; a eficácia mediata dos direitos fundamentais; e a eficácia imediata desses preceitos às relações privadas.
