The use of artificial intelligence tools in the brazilian judiciary and CNJ Resolution 332/2020

Resumo: It is a fact that society has gone through several transformations which the law must always accompany. Recently, with the advent of new technologies, in order to achieve greater procedural speed, especially in the face of such a conflicting society, the Brazilian judicial system started to adopt some tools equipped with artificial intelligence to assist in various ways, such as, for example, counting of procedural deadlines. Thus, in order to provide legal certainty for the parties and the process itself, Resolution 332 of 2020 of the National Council of Justice came to recommend ethical guidelines for the use of these tools in Brazilian law. Thus, this study focused on studying the artificial intelligence tools at work in the judiciary in the Brazilian territory, as well as the purpose of the aforementioned resolution of the CNJ and its effects. To carry out this research, the hypothetical-deductive method was used, with the technique of bibliographic research, using the exploratory type, with a qualitative approach.

Recientemente, con el advenimiento de las nuevas tecnologías, con el fin de lograr una mayor celeridad procesal, especialmente frente a una sociedad tan conflictiva, el sistema judicial brasileño comenzó a adoptar algunas herramientas equipadas con inteligencia artificial para asistir de diversas formas, tales como, para ejemplo, recuento de plazos procesales. Así, con el fin de brindar seguridad jurídica a las partes y al propio proceso, la Resolución 332 de 2020 del Consejo Nacional de Justicia llegó a recomendar pautas éticas para el uso de estas herramientas en la legislación brasileña. Así, este estudio se centró en estudiar las herramientas de inteligencia artificial en funcionamiento en el poder judicial en el territorio brasileño, así como el propósito de la mencionada resolución del CNJ y sus efectos. Para la realización de esta investigación se utilizó el método hipotético-deductivo, con la técnica de investigación bibliográfica, utilizando el tipo exploratorio, con enfoque cualitativo.É fato que a sociedade tem passado por diversas transformações as quais o direito deve sempre acompanhar. Recentemente, com o advento das novas tecnologias, para se alcançar uma maior celeridade processual, principalmente diante de uma sociedade tão conflitante, o sistema judiciário brasileiro passou a adotar algumas ferramentas dotadas de inteligência artificial para auxiliar nas mais diversas formas, como por exemplo, a contagem de prazos processuais. Dessa forma, com o intuito de dar segurança jurídica às partes e ao processo em si, veio a Resolução 332 de 2020 do Conselho Nacional de Justiça a fim de recomendar diretrizes éticas para a utilização dessas ferramentas no jurídico brasileiro. Assim, o presente estudo se concentrou em estudar as ferramentas de inteligência artificial em funcionamento nos judiciários do território brasileiro, bem como o intuito da referida resolução do CNJ e seus efeitos.
