Effective Abandonment of the Child as a Violation of the Rights of the Person

Resumo: Affection is the most determining theme in family relationships, especially between parents and children. The human being who always had the special protection of the mens legis cannot be subjected to abandonment by the holders of family authority. Attendance to obligations inherent to parents’ authority should not be restricted to a mere protective behavior and to material and intellectual assistance but especially in the duty to care and treat children with emotions and feelings. Children require a humanized attendance. Through such behavior, children’s personality is thus modeled towards the building of a society in which the principle of the dignity of the human person predominates.

Não se pode descurar que o ser humano que sempre mereceu particular proteção do mens legis, fique ao desamparo dos titulares do poder familiar. O cumprimento dos deveres inerentes ao pátrio poder não se circunscreve apenas nas obrigações de mera conduta de proteção, assistência material, intelectual, mas sim no dever de cuidar e tratá-los com emoções e sentimentos. Os filhos merecem um novo olhar, um olhar claramente humanizado.
