Substantialism and the Rights of the Person with Deficiency: The Process’s Social Function

Resumo: Every citizen has the right to effectively access the Judiciary. The juridical activity is effective, or rather, its decisions are complied with through the person of the judge and, consequently, they should be effective and able to achieve justice. In the wake of the above, it seems that the people with deficiency lack judicial access to the Judiciary since, due to their deficiency, they may not bear the type of bureaucracy within the context of juridical activity. Consequently, the desired and required impact is not conceded. Further, there are frequent situations in which the legal activity leads towards a legislative symbolism which foregrounds the difficulties experienced by the judge to accomplish jurisdictional tutelage and concede a correct and just decision. In fact, people with deficiency have the right to a just, free and un-impeded process.

Y por cierto que la actividad jurisdiccional sea efectiva, más precisamente, para que las decisiones por ella exoradas, en la figura del magistrado, deben ser efectivas y capaces de cumplir su arrimo de justicia. En este ámbito, nos parece que falta todavía más de tal tutela a la persona discapacitada, la cual, frente a sus limitaciones, muchas veces no puede esperar toda la burocracia existente para la prestación jurisdiccional, bajo la pena de, al hacerse efectiva, no más presentar el impacto deseado y necesario. Como si no bastara, muchas veces nos deparamos con situaciones donde la actividad legiferante camina rumbo a un simbolismo legislativo, lo que por cierto conduce a dificultades por parte del magistrado para concretar la tutela jurisdiccional y conceder al caso concreto la decisión correcta y justa. Así, la persona discapacitada merece tener acceso a un proceso justo, libre y despejado.Todos os cidadãos merecem ter acesso a um Poder Judiciário atuante e efetivo. E por certo que a atividade jurisdicional seja efetivada, mais precisamente, as decisões por ele exaradas, na figura do magistrado, e por isso devam ser efetivas e capazes de cumprir seu condão de justiça. Nesta seara nos parece que carece ainda mais de tal tutela a pessoa com deficiência, a qual, em virtude de suas limitações, muitas vezes não pode aguardar toda a burocracia existente para a prestação jurisdicional, sob pena de, ao efetivar-se, não mais apresentar o impacto desejado e necessário. Como se não bastasse, muitas vezes nos deparamos com situações onde a atividade legiferante caminha rumo a um simbolismo legislativo, o que por certo conduz a dificuldades por parte do magistrado para efetivar a tutela jurisdicional e conceder ao caso concreto a decisão correta e justa.
