Resumo: The informed consent is very important in gauging the physician’s responsibility. Legitimizing the doctor’s actions. His achievement is mandatory, except in cases of therapeutic privilege, compulsory treatment and surrendering the right to the information. There was, initially, a study regarding the civil liability with reference to the physician’s activity to a better understand the institute of informed consent. After these considerations, it was made a more detailed analysis of the doctor's responsibility in cases of informed consent lack. This article has the scope to clarify the physicians and patients’ rights and duties to avoid the constant judicial demands that overflow in the Brazilian Judiciary.
