Resumo: Transsexuality, understood as a Gender Identity Disorder, it becomes intensely debated from the moment we get the possibility of surgical intervention for the adequation of biological sex to the psychological gender, with the diagnosis of such cases. The study asks the existence of the reassignment right from the syndrome and the legal repercussions observation arising from it. From this, transgenital surgery comes as the fulfillment of constitutional principles such as human dignity, which is based in the free unfolding of personality and the right to health, understood in a wide sense, such as physical and psychic. Moreover, the work, rooted in the hermeneutic method, investigates the right to gender reassignment and first name, which allows the emergence of a new legal personality, that is why we investigate the legal consequences.

El trabajo cuestiona la existencia de un derecho a la redesignación sexual a partir de la constatación del síndrome y de las repercusiones jurídicas de ella advenidas. En ese contexto, la intervención quirúrgica de transgenitalización surge como la concretización de principios constitucionales como el de la dignidad de persona humana, en que se funda el libre desdoblamiento de la personalidad, y no derecho a la salud, comprendida en un sentido mucho más amplio, como salud física y psíquica. Además de eso, el trabajo, basado en el método hermenéutico, averigua el derecho a la redesignación de género y nombre, lo que permite el surgimiento de una nueva personalidad jurídica, razón por la cual se investigan las consecuencias jurídicas que de ellas recurren.A transexualidade, entendida como Transtorno de Identidade de Gênero, torna-se mais intensamente debatida a partir do momento em que surge a possibilidade de intervenção cirúrgica para a adequação do sexo biológico ao sexo psíquico, com o diagnóstico de tais casos. O trabalho questiona a existência de um direito a redesignação sexual a partir da constatação da síndrome e das repercussões jurídicas dela oriundas. Nesse mote, a cirurgia de transgenitalização surge como a concretização de princípios constitucionais como o da dignidade da pessoa humana, em que se funda o livre desdobramento da personalidade, e no direto à saúde, compreendida em um sentido muito mais amplo, como saúde física e psíquica.
