Labor reform from the human rights perspective

Summary: This article reflects on the Labor Reform, Law No. 13.467 / 2017 in the light of the Universal Declaration of Human Rights, bringing a historical retrospective of human and labor rights, the emergence of the Universal Declaration of Human Rights and Labor Law in Brazil and on the reach by Brazilian workers of rights and guarantees over the years until the Federal Constitution of the Republic of 1988. The methodology is that of bibliographic review. It also reflects on the flexibilization of these rights after the Labor Reform and its consequences on human rights. It appears that many workers' rights have been changed, such as the provision of work modalities without guarantee of stability, entry in the Work Card or integration with Social Security, possibility of increasing the working day and reducing rest and meal hours.

La metodología es la de revisión bibliográfica. También reflexiona sobre la flexibilización de estos derechos después de la Reforma Laboral y sus consecuencias sobre los derechos humanos. Parece que muchos derechos de los trabajadores han cambiado, como la provisión de modalidades de trabajo sin garantía de estabilidad, entrada en la tarjeta de trabajo o integración con la Seguridad Social, posibilidad de aumentar la jornada laboral y reducir las horas de descanso y comida.O objetivo do presente artigo é realizar uma reflexão acerca da Reforma Trabalhista, Lei nº 13.467/2017 à luz da Declaração Universal dos Direitos do Homem, trazendo uma retrospectiva histórica dos direitos humanos e do trabalho, do surgimento do Direito da Declaração Universal dos Direitos do Homem e do Direito do Trabalho no Brasil e sobre o alcance pelos trabalhadores brasileiros de direitos e garantias ao longo dos anos até a Constituição Federal da República de 1988. A metodologia é a da revisão bibliográfica. Reflete ainda, sobre a flexibilização destes direitos a partir da Reforma Trabalhista e suas consequências sobre os direitos humanos. Verificam-se que muitos direitos dos trabalhadores foram alterados, como a previsão de modalidades de trabalho sem garantia de estabilidade, anotação na Carteira de Trabalho ou integração à Previdência Social, possibilidade de aumento da jornada de trabalho e redução de horário de descanso e refeição.
