Impact of papilloscopic expert reports at crime sites on court decisions

Resumo: This article proposes to verify the impact that the Papilloscopic Examination Reports of crime places, issued by the Papilloscopists of the Federal Police, produce or not in the respective decisions in the judicial processes. This is a quantitative and qualitative study, based on a census of papilloscopic crime scene reports produced from 2013 to 2016 in the Federal Police Superintendency in Belém-PA. The results showed that these technical documents had an impact in order to convince the Attorneys of the Republic and the Federal Judges that the individual indicated by this report, in fact, represents the perpetrator of the crime. As a consequence, the manifestations of the members of the Public Prosecutor's Office in favor of preventive detention are based on the individual described in the reports of papilloscopic expertise, as well as the complaints offered to the Justice. In the same way, the Federal Judges, in the judicial processes concerning these reports, decreed preventive detention and even condemned, in a judicial sentence, the persons indicated by these technical documents, confirming the repercussion of the reports in the judicial decisions.

Este es un estudio cuantitativo y cualitativo, basado en un censo de informes papilloscópicos de la escena del crimen producidos entre 2013 y 2016 en la Superintendencia de la Policía Federal en Belém-PA. Los resultados mostraron que estos documentos técnicos tuvieron un impacto para convencer a los fiscales y a los jueces federales de que la persona indicada en este informe, de hecho, representa al autor del delito. Como consecuencia, las manifestaciones de los miembros de la Fiscalía a favor de la detención preventiva se basan en la persona descrita en los informes de pericia papiloscópica, así como en las denuncias ofrecidas a la Justicia. Del mismo modo, los Jueces Federales, en los procesos judiciales relacionados con estos informes, decretaron la detención preventiva e incluso condenaron, en una sentencia judicial, a las personas indicadas en estos documentos técnicos, confirmando la repercusión de los informes en las decisiones judiciales.O presente artigo se propõe a verificar o impacto que os Laudos de Perícias Papiloscópicas de locais de crime, emitidos pelos Papiloscopistas da Polícia Federal, produzem ou não nas respectivas decisões nos processos judiciais. Trata-se de um estudo quanti-qualitativo, a partir de um censo dos laudos papiloscópicos de local de crime produzidos de 2013 a 2016 na circunscrição da Superintendência da Polícia Federal em Belém-PA. Os resultados demonstraram que esses documentos técnicos impactaram de forma a convencer os Procuradores da República e os Juízes Federais de que o indivíduo indicado por esse laudo, de fato, representa o autor do crime. Como consequência, as manifestações dos membros do Ministério Público favoráveis à prisão preventiva tomaram por base o indivíduo descrito nos laudos de perícia papiloscópica, assim como as denúncias oferecidas à Justiça.
