Heterologous artificial insemination: the conflict between the right to recognition of genetic origin and donor intimacy

Resumo: The present article sought to discuss how the Brazilian legal system sees the conflict between the recognition of genetic origin and the intimacy of the gamete donor and the future weight of the heterologous artificial insemination technique in the life of the individual generated from it, since it does not there is normalization in addition to the subjective concepts applied to each case. Therefore, the work was based on a qualitative study developed through bibliographic research, analyzing the relevant themes that permeate the theme, namely: family planning, sexual and reproductive rights, among others. Considering also the constitutional perspective and the conflicts of constitutional norms of the right to intimacy and identity, which have been placed on opposite sides, when in fact they are species that derive from the right to personality. The general objective was to analyze the best way to solve the antagonism of the theme, that is, the right to recognition of genetic origin and the right to identity and intimacy of the donor. It was shown that the best way to resolve the impasse is from the principled weighting of the norms, as in the Brazilian legal system there is no hierarchy between constitutional principles, whether explicit or implicit, as well as, there is no regulatory law, thus, to find out what the outlines of the fundamental rights and the identity of the donor and the individual are more than necessary as a matter of law there is a democratic and reassuring state that seeks the dignity of the human person on both sides.

Por lo tanto, el trabajo se basó en un estudio cualitativo desarrollado a través de la investigación bibliográfica, analizando los temas relevantes que permean el tema, a saber: la planificación familiar, los derechos sexuales y reproductivos, entre otros. Considerando también la perspectiva constitucional y los conflictos de normas constitucionales del derecho a la intimidad ya la identidad, las cuales han sido colocadas en bandos opuestos, cuando en realidad son especies que derivan del derecho a la personalidad. El objetivo general fue analizar la mejor manera de resolver el antagonismo del tema, o sea, el derecho al reconocimiento del origen genético y el derecho a la identidad e intimidad del donante. Se demostró que la mejor manera de resolver el impasse es a partir de la ponderación principista de las normas, ya que en el ordenamiento jurídico brasileño no existe jerarquía entre los principios constitucionales, ya sean explícitos o implícitos, así como tampoco existe ley reglamentaria, por lo tanto , averiguar cuáles son los contornos de los derechos fundamentales y la identidad del donante y del individuo son más que necesarios como cuestión de derecho hay un estado democrático y tranquilizador que busca la dignidad de la persona humana por ambas partes.O presente artigo buscou discorrer sobre como o ordenamento jurídico brasileiro vê o conflito entre o reconhecimento da origem genética e a intimidade do doador de gametas e o futuro peso da técnica de inseminação artificial heteróloga na vida do indivíduo gerado a partir dela, uma vez que não há normatização além dos conceitos subjetivos aplicados a cada caso. Para tanto, o trabalho deu-se a partir de um estudo qualitativo desenvolvido por meio de pesquisa bibliografia, analisando as temáticas relevantes que permeiam o tema, sendo eles: o planejamento familiar, direito sexuais e reprodutivos, entre outros. Considerando, ainda, a perspectiva constitucional e os conflitos de normas constitucionais de direito a intimidade e identidade, que têm sido colocadas em lados opostos, quando na verdade são espécies que derivam de direito à personalidade. O objetivo geral foi analisar a melhor forma para solucionar o antagonismo do tema: o direito ao reconhecimento da origem genética e o direito à identidade e intimidade do doador.
