Resumo: This study assessed the laws governing education in the Brazilian State from the Federal Constitution of 1988 (art. 6º, art. 205, art. 206, art. 208) with the aim of addressing education as a social right, as well as understanding it as a fundamental right that depends on citizenship for its realization. The research following a qualitative approach, with collection of bibliographic-documentary data in order to help us understand and interpretation of constitutional articles. We realize that constitutional legislation systematizes mechanisms that provide support for laws and projects aims at to improve education and citizenship. In addition, for the materialization of constitutional articles the citizens must know their rights and duties to achieve on collective action. Therefore, it is necessary that each citizen understands the legislation in order to demand the real fulfillment of a society like the Brazilian.

El objetivo es abordar la educación como forma de derecho social en 4 disposiciones constitucionales (art. 6, art. 205, art. 206, art. 208), así como entenderla como un derecho fundamental dependiente de la ciudadanía para su implementación. La investigación siguió un enfoque cualitativo, con datos recolectados a partir del análisis documental-bibliográfico que sustentan la comprensión e interpretación de los artículos constitucionales. Percibimos que la legislación educativa en la Constitución sistematiza dispositivos que apoyan proyectos específicos y leyes que garantizan la promoción de la educación y la ciudadanía. Además, la implementación de los artículos constitucionales depende de ciudadanos que conozcan los derechos y deberes para lograr las metas colectivas. Todavía, es necesario que cada ciudadano individual y colectivamente esté dispuesto a comprender el funcionamiento de la legislación y a abordar los mecanismos que den visibilidad a los requisitos para el funcionamiento real de una sociedad como la brasileña.O trabalho versa sobre a Constituição Federal de 1988 como princípio norteador para leis que regem a educação no estado brasileiro. O objetivo é abordar a educação como forma de direito social a partir de 4 dispositivos constitucionais (art. 6º, art. 205, art. 206, art. 208), bem como compreendê-la como direito fundamental que depende da cidadania para sua concretização. A pesquisa seguiu uma abordagem qualitativa, sendo os dados coletados a partir da análise documental-bibliográfica que fundamentam a compreensão e interpretação dos artigos constitucionais. Percebemos que a legislação educacional na Constituição sistematiza dispositivos que dão embasamento para projetos e leis específicas que garantem a promoção da educação e da cidadania. Além disso, a concretização dos artigos constitucionais carece dos cidadãos que conhecem direitos e deveres para atingir objetivos coletivos.
