The new regulatory framework for basic sanitation and the right to access to water

Resumo: This article makes a brief study of the importance of the universality of policies for the implementation of access to water and basic sanitation in Brazil by analyzing Law nº 14.026/2020 of the New regulatory Framework for Basic Sanitation, which has as its main focus to promote access until 2033 through water and sanitation policy services that are provided by the public administration and private companies. Therefore, this research seeks to identify the main innovations and contradictions promoted by this law, which defends privatization by groups linked to state and municipal interests in order to avoid political and economic costs. Thus, a literature review was carried out through the methods of deductive procedure, through exploratory research using bibliographic, qualitative and documentary data. From the results obtained, it was noticed that the law has as a priority the access to universalization of drinking water and basic sanitation services, however, this law intends to destabilize the state, starting to privatize the services so that the goals are achieved and in Contrary to this, many people are unable to afford the high fees charged for services offered by private companies, as this attempt to promote water universalization must be redirected so that everyone has access to water and sanitation services regardless of income or social condition, since the use of water is consolidated as a fundamental human right, this public will have to be attended to, regardless of whether the supply service is public or private.

Por ello, esta investigación busca identificar las principales innovaciones y contradicciones que promueve esta ley, que defiende la privatización por parte de grupos vinculados a intereses estatales y municipales con el fin de evitar costos políticos y económicos. Así, se realizó una revisión de la literatura a través de los métodos del procedimiento deductivo, a través de una investigación exploratoria utilizando datos bibliográficos, cualitativos y documentales. A partir de los resultados obtenidos, se advirtió que la ley tiene como prioridad el acceso a la universalización de los servicios de agua potable y saneamiento básico, sin embargo, esta ley pretende desestabilizar al estado privatizando los servicios para que se logren las metas y contrariamente a esto. , muchas personas no pueden pagar las altas tarifas que cobran por los servicios que ofrecen las empresas privadas, ya que este intento de promover la universalización del agua debe reorientarse para que todos tengan acceso a los servicios de agua y saneamiento independientemente de sus ingresos o condición social, ya que el uso del agua se consolida como un derecho humano fundamental, este público deberá ser atendido, independientemente de que el servicio de suministro sea público o privado.O presente artigo faz um breve estudo da importância da universalidade das políticas de implementação de acesso a água e saneamento básico no Brasil ao fazer uma análise da Lei nº 14.026/2020 do Novo Marco Regulatório do Saneamento Básico, que tem como foco principal promover um acesso igualitário até 2033, através dos serviços de políticas de água e de saneamento que são fornecidos pela administração pública e empresas privadas. Para tanto, essa pesquisa busca identificar as principais inovações e contradições promovidas por essa lei, que defende a privatização pelos grupos ligados aos interesses estaduais e municipais no sentido de evitar os custos políticos e econômicos. Dessa forma, foi realizada uma revisão de literatura através dos métodos de procedimento dedutivo, através de pesquisa exploratória utilizando dados bibliográficos, qualitativo e documental.
