Endogenous criminal organizations in the State of Pará-Brazil: agents and modus operandi

Resumo: Currently, it has been verified, both in academic research and in political-institutional discussions, proposals on how to fight criminal organizations more effectively, since organized crime is increasingly closely associated with the action of the State. This paper aims to demonstrate which are the endogenous criminal organizations in the State of Pará and how they act, based on the analysis of criminal actions filed by the Special Action Group to Combat Organized Crime of the Public Ministry (State Prosecution) of the State of Pará. Using the technique of descriptive statistics with a quantitative focus of the data, the present research was primarily based on a documentary analysis, from a census of criminal actions filed in the period from 2014 to 2018, in the State of Pará. The results point to the existence of 4 (four) types of criminal organizations with different forms of action, practicing criminal conduct such as passive corruption, fraudulent misrepresentation, insertion of false data in information systems, money laundering, among others, in several municipalities in the State of Pará, as well as in other states, causing serious damage to the community. Thus, it can be concluded that there are criminal groups in the State of Pará that rely on the direct participation of public agents, and even those formed exclusively by public servants, contributing to the success of the criminal enterprise.

El presente artículo tiene como objetivo demostrar qué son y cómo operan las organizaciones criminales endógenas en el Estado de Pará, a través del análisis de acciones criminales propuestas por el Grupo de Acción Especial para Combatir el Crimen Organizado del Ministerio Público del Estado de Pará. Utilizando la técnica de estadística descriptiva con un enfoque cuantitativo de los datos, la investigación utilizó primero un análisis documental, basado en un censo de las acciones criminales propuestas en el período de 2014 a 2018, en el Estado de Pará. Los resultados indican la existencia de 4 (cuatro) tipos de organizaciones criminales, con diferentes formas de acción, practicando conductas criminales como corrupción pasiva, falsedad ideológica, inserción de datos falsos en sistemas de información, lavado de dinero, entre otros, en varios municipios del Estado de Pará, así como en otros estados, causando graves daños a la comunidad. Así, se concluye que en el Estado de Pará hay grupos criminales que dependen de la participación directa de agentes públicos, o incluso que están formados exclusivamente por funcionarios públicos, lo que contribuye al éxito de la actividad criminal.O que se tem verificado atualmente, tanto nas pesquisas acadêmicas, quanto nas discussões políticas-institucionais, é como combater de forma eficaz às organizações criminosas, visto que o crime organizado é cada vez mais simbiótico ao Estado. O artigo se propõe a demonstrar quais são e como atuam às organizações criminosas endógenas no Estado do Pará, a partir de ações penais propostas pelo Grupo de Atuação Especial no Combate ao Crime Organizado do Ministério Público do Estado do Pará. O estudo utilizando-se da técnica da estatística descritiva, com enfoque quantitativo dos dados, parte de uma análise documental, a partir de um censo das ações penais propostas, no período de 2014 a 2018, no Estado do Pará. Os resultados apontam a existência de 4 (quatro) tipos de organizações criminosas, com diferentes formas de atuação, praticando condutas criminosas como corrupção passiva, falsidade ideológica, inserção de dados falsos em sistemas de informação, lavagem de dinheiro, etc., em vários municípios do Estado do Pará, bem como, em outros Estados, causando graves prejuízos à coletividade.
