State perfectionism: A critical analysis of John Rawls based on John Finnis' new natural law theory

Resumo: The purpose of this article is to present the state perfectionism defended by the neoclassical tradition of natural law – especially from the analytical philosopher of law John Finnis. Such political theory argued that the State can and should intervene in the lives of its citizens in favor of a perspective of good life or human flourishing. However, as a central issue, it is questioned that, in a plural and democratic society, there is supposedly the indispensability of a neutral state action, which does not benefit individuals based on controversial and contradictory views of excellence. Thus, with the objective of scrutinizing the exposed demand, first, it investigates the conception supported by John Rawls, prominent defender of state anti-perfectionism in the 20th century; then, it analyzes the foundation of the finnisian political theory – community, flourishing and authority –; so that, finally, after the criticism directed at Rawlsian arguments, the delimitation of the political common good, as the sphere of state action in the conduct of people, can emerge as a perfectionist political alternative.

Tal teoría política argumentó que el Estado puede y debe intervenir en la vida de sus ciudadanos a favor de una perspectiva de buena vida o florecimiento humano. Sin embargo, como tema central, se cuestiona que, en una sociedad plural y democrática, supuestamente existe la indispensabilidad de una acción estatal neutral, que no beneficia a los individuos en base a visiones de excelencia controvertidas y contradictorias. Así, con el objetivo de escudriñar la demanda expuesta, en primer lugar se indaga en la concepción sustentada por John Rawls, destacado defensor del antiperfeccionismo estatal en el siglo XX; luego, analiza el fundamento de la teoría política finlandesa - comunidad, florecimiento y autoridad -; para que, finalmente, tras la crítica dirigida a los argumentos rawlsianos, la delimitación del bien común político, como ámbito de acción estatal en la conducta de las personas, pueda emerger como una alternativa política perfeccionista.Lo scopo di questo articolo è presentare il perfezionismo statale difeso dalla tradizione neoclassica del diritto naturale, in particolare dal filosofo analitico del diritto John Finnis. Tale teoria politica sosteneva che lo Stato può e deve intervenire nella vita dei suoi cittadini a favore di una prospettiva di vita buona o di prosperità umana. Tuttavia, come questione centrale, viene messo in dubbio che, in una società plurale e democratica, vi sia presumibilmente l'indispensabilità di un'azione statale neutrale, che non vada a vantaggio di individui basati su visioni di eccellenza controverse e contraddittorie. Così, con l'obiettivo di scrutare la domanda esposta, in primo luogo, indaga la concezione sostenuta da John Rawls, eminente difensore dell'anti-perfezionismo di stato nel XX secolo; poi, analizza il fondamento della teoria politica finlandese – comunità, fioritura e autorità –; sicché, finalmente, dopo la critica rivolta agli argomenti rawlsiani, la delimitazione del bene comune politico, come sfera dell'azione statale nella condotta delle persone, può emergere come alternativa politica perfezionista.O presente artigo tem como propósito apresentar o perfeccionismo estatal defendido pela tradição neoclássica da lei natural – especialmente a partir do filósofo analítico do Direito John Finnis. Tal teoria argui que o Estado pode intervir na vida de seus cidadãos em prol de uma perspectiva de vida boa ou de florescimento humano. Como problemática central, no entanto, questiona-se o fato de que, em uma sociedade plural e democrática, supostamente existiria a indispensabilidade de uma atuação estatal neutra, a qual não beneficia os indivíduos tendo como base visões polêmicas e contraditórias de excelência.
